The small print, in large print
The rules,in plain English.
The short version
The free check is free and only reads what any visitor can see. Paid plans run month to month or year to year and you can stop whenever you like. Fixes are quoted first and nothing is done until you say yes.
Who you are dealing with
Mendbird is run by Moonlathe Technologies Ltd, a company registered in England and Wales, company number 17493793. "We" means us; "you" means the person or business using Mendbird. Questions go to hello@mendbird.com.
The free check
Anyone can check any public website, because the check only reads what any visitor can see. Please do not use it to check sites at a volume that would bother their owners; we limit how many checks one visitor can run.
A report is our best reading of a site from the outside, on the day. It can miss things a check from outside cannot see, and now and then it can be wrong. It is not a security audit or a guarantee that a site is safe, and you should not rely on it alone for decisions where a mistake would be costly.
Watching and the free trial
The Watch plan is £9 a month or £90 a year for one site. The Agency plan is £49 a month for up to 25 sites, or £99 a month for up to 100. We are not registered for VAT, so the price shown is what you pay. If that changes, we will tell you before your next payment.
A new plan starts with a 14 day free trial, with no card needed. If you have not added a card by the end of it, watching stops and nothing is charged. One trial per person and per site.
Plans renew automatically at the end of each month or year until you cancel. You can cancel at any time from your account, and your plan carries on to the end of the period you have paid for. If you buy as a consumer, you can cancel within 14 days of your first payment for a full refund. We may change prices with at least 30 days' notice by email, and the new price only applies from your next renewal after that notice.
The Mendbird helper
The helper is a WordPress plugin, a single file, or a small program, depending on your site. It only reads: it lists the software your site runs and the versions, and sends that to us. It does not change your site and does not send your content, your customers' details or passwords. You choose to install it and you can remove it at any time.
Install it only on sites you own or look after with the owner's permission. On the Agency plan, you confirm you have permission for every site you add.
Alerts
We check every morning and email you when we find something new. We work hard to make alerts timely and right, but lists of flaws are published by others and sometimes late or wrong, and email can be delayed. Alerts help you look after a site; keeping it safe is still down to you or your developer.
Fixes
If you ask us to fix something, we quote a fixed price first. Nothing is done until you say yes in writing. If the job takes longer than we expected, the price does not change. If you ask for more after we have started, that is a new quote, agreed before we do it. Payment for a fix is due within 14 days of the invoice. We will need access to your site, and we use it only for the job.
Using Mendbird fairly
Please do not try to break, overload or copy Mendbird, get around its limits, or use it to harm someone else's site. We can suspend an account that does, and we will tell you why.
If something goes wrong
If a fix we did does not do what we agreed, tell us and we will put it right at our cost.
Beyond that, our total liability to a business in any 12 months is limited to what you paid us in that time. We are not liable to a business for lost profits, lost data you had not backed up, or losses we could not reasonably have seen coming. Nothing here limits liability for death, personal injury, fraud or anything else the law says cannot be limited, and nothing here affects your legal rights as a consumer.
Ending it
You can close your account at any time. We can end a plan with 30 days' notice, and refund any part you have paid for and not used. If we have to stop Mendbird altogether, we will give you as much notice as we can and refund what is left.
The legal bits
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, though a consumer living in Scotland or Northern Ireland can also use their local courts. If any part is found to be unenforceable, the rest still stands. We may update these terms; the date at the top changes when we do, and we email account holders about anything that affects them.
